PERSONAL INJURIES ASSESSMENT BOARD (‘PIAB’) Since the coming into force of the Personal Injuries Assessment Board Act 2003, the law relating to the litigation of personal injury claims in Ireland has changed dramatically. Under the Act all claims for personal injury (excluding medical negligence claims) must first be submitted to the Board for consideration. This is a pre-requisite to the institution of proceedings. We strongly recommend that any person proposing to make any application to PIAB firstly seek legal advice. The High Court has recently made a finding that it is the entitlement of every injured party to be allowed legal representation. The Board is an independent body funded by the Government. Its purpose is to assess the amount of compensation due to an injured party in cases where liability has been admitted (i.e. the Defendant or wrongdoer has accepted blame for the injuries caused as a result of their actions). Since the setting up of PIAB our firm has dealt with the Board in assisting a broad spectrum of clients in processing their claims.
